PRM SERVICES AT AIRPORTS IN BIH – EU GUIDELINES AND STANDARDS

ABSTRACT: The European Union by virtue of its legal acts guarantees a high level of protection and the equality for all passengers. Passengers with dissabilities and reduced mobility –PRM must be provided with the opportunity of using transportation comparable to those of other passengers. Consequent to the request of a passenger for assistance at the airport he is considered to be under the auspices of the airline carrier, that is their representative – the airport operator, bearing legal liability for the provision of assistance to passengers. The aim of this report is to highlight the necessity for the compentancy of the personnel involved in the handling of PRM, in line with the international standards and domestic regulations. The EU1107/2016 regulations that has been incorporated into the Law on contractual obligations in civil aviation precisely defines the requirements that need to be fulfilled in respect to the provision of PRM service in air traffic, including the certification of activities and tasks of the personnel involved in the said processes. The implementation of these statutes is under the authority of the Airport management. The oversight of the implementation of the statutes pertaining to the Rights of passengers with disabilities and reduced mobility is under the authority of the regulatory body BHDCA.

 

SAŽETAK: Evropska unija svojim pravnim aktima garantira visoku razinu zaštite i jednakopravnosti svih putnika. Putnici s invaliditetom i ograničenom pokretljivošću – PRM4 moraju imati mogućnosti korištenja prijevoza usporedive sa mogućnostima ostalih putnika. Nakon što je putnik zatražio pomoć na aerodromu smatra se da se on nalazi u nadležnosti zrakoplovnog prijevoznika, odnosno njegovog zastupnika – aerodromskog operatera, što podrazumijeva pravnu odgovornost za pružanje pomoći putnicima. Cilj ovog rada jeste da ukaže na nužnost osposobljavanja osoblja uključenog u opslugu PRM, u skladu sa međunarodnim standardima i domaćom regulativom. Uredba EU1107/2006 koja je inkorporirana u Zakon o obligacionim odnosima u civilnom zrakoplovstvu precizno definira uvjete koji moraju biti zadovoljeni u pogledu opsluge PRM u zračnom saobraćaju, uključujući certificiranje poslova i zadataka osoblja uključenog u ove procese. Nadležnost nad provedbom ovih odredbi jeste na upravnim tijelima aerodroma. Regulatorno tijelo BHDCA nadležno je za nadzor nad provođenjem odredbi o pravima putnika sa invaliditetom i smanjenom pokretljivošću.
