CERTIFICATION AND TRAINING FOR PROFESSIONALS FOR PUBLIC PROCUREMENT IN THE CONTEXT OF DIRECTIVE 2014/25 / EC ON PROCUREMENT OF ENTITIES OPERATING IN THE WATER, ENERGY, TRANSPORT AND POSTAL SERVICES - STATE AND OBLIGATIONS OF BOSNIA AND HERZEGOVINA

ABSTRACT: Inadequate training of personnel is often a limiting factor in the implementation of the public procurement process in the sectors of infrastructure, such as heavy traffic. For this reason, the paper examines the importance and obligation of certification and specialization of experts on public procurement in the context of Directive 2014/25 / EU of the European Parliament and Council of 26 January 2014 on the procurement of entities operating in the water, energy, transport and postal service. The aim of certification and specialization of experts in public procurement is to ensure quality preparation and implementation of public procurement procedures, where contracting authorities must possess a minimum of trained human resources, and therefore valid certificate confirming possession of critical knowledge and necessary skills. In most developing countries as well as in Bosnia and Herzegovina are noticeable disadvantages administrative capacity for large procurement especially in the context of the successful absorption of funds from the European structural and investment funds, and insufficient experience, especially at the local level, which necessarily imposes the need for further training of professionals public procurement, their certification and specialization. It is important to build quality and integrated system and educational networks, in order to process the result was a resource with new knowledge and skills, considering that ignorance is a bottleneck for the absorption of funds from the European structural and investment funds, especially in the sectors of heavy infrastructure.

 

SAŽETAK: Problem nedovoljne educiranosti kadrova predstavlja ograničavajući faktor u implementaciji procesa javnih nabavki u sektorima teške infrastrukture poput prometa. Upravo zbog toga u radu se sagledava proces i obaveza certificiranja i specijalizacije eksperata za javne nabavke u kontekstu Direktive 2014/25/EU Evropskog parlamenta i vijeća od 26. januara 2014. godine o nabavkama subjekata koji djeluju u vodoprivrednom, energetskom i prometnom sektoru te sektoru poštanskih usluga. Cilj certificiranja i specijalizacije stručnjaka za javne nabavke je osigurati kvalitetnu pripremu i provedbu postupaka javne nabavke gdje Ugovorni organi moraju raspolagati sa minimumom educiranih kadrovskih resursa, a time i važećih certifikata kojim se potvrđuje posjedovanje kritičnog znanja i nužnih vještina. U većini predpristupnih zemalja pa tako i u Bosni i Hercegovini primjetni su nedostaci administrativnih kapaciteta za velike javne nabavke a posebno u kontekstu uspješne apsorpcije sredstava iz Evropskih strukturnih i investicijskih fondova, te nedovoljno iskustvo, pogotovo na lokalnom nivou, što nužno nameće potrebe za dodatnom edukacijom stručnjaka za javne nabavke, njihovim certificiranjem i specijalizacijom. U tom kontekstu veoma je važno da se izgradi kvalitetan i integriran sistem i edukacijska mreža, kako bi rezultat procesa bio resurs s novim znanjima i vještinama, obzirom da je neznanje usko grlo za apsorpciju sredstava iz evropskih strukturnih i investicijskih fondova, a posebno u sektorima teške infrastrukture.
