GUIDELINES OF THE EUROPEAN UNION AND CERTIFICATION DUETS AND TASKS IN THE RAILWAY TRAFFIC IN THE FB&H AND B&H

ABSTRACT: Directive, the Regulation and the Decision of the European Community by rail directly or indirectly already included in the national legislation of member states. Railway sector in B&H and National institutions and public authorities are facing the challenge of preparation and readiness of the European takeover rules in the field of railways. Virtually present a complete railway system in B&H is competent certification according to the European rules, in this or that way. The certification process are subject to: the present public rail carriers, infrastructure managers, railway staff and special staff on trains moving on the territory of the European Community, rolling stock, workshops for maintenance of railway rolling stock, materials and equipment railway. Obligations arising from European rules for rail system, requiring redizajin public railway companies in BiH, the Regulatory Committee on railways of B&H and B&H railways public corporations. BiH's accession into the European Union, leading to the application of directives and regulations for the railways into national law, a task for the railway sector in BiH and for government officials. The vast obstacle is the method of preparation of railway companies to access the European market. Especially important are the present and future obligations of railway infrastructure, because with the current mode of domestic public rail carriers may operate independently economically. Sustainable business of railway infrastructure without the expenses of its maintenance is not possible, but at the same time the question is whether it will eventually open up the market to produce higher revenues for railway infrastructure. Overall, it appears that the existing legal framework flexible to quickly adapt to European rules, but the main obstacle is the technical and economic part.

 

SAŽETAK: Direktive, Uredbe i Odluke EZ u željezničkom saobraćaju posredno ili neposredno već ulaze u nacionalne propise zemalja članica. Željeznički sektor u BiH, Nacionalne institucije i nosioci vlasti su pred izazovom pripreme i spremnosti preuzimanja Evropskih pravila u oblasti željeznice. Praktično sadašnji kompletan željeznički sistem u BiH podležan je cerifikaciji prema Evropskim pravilima, na ovaj ili onaj način. Procesu certifikacije podliježu: sadašnji javni željeznički prijevoznici, upravitelji infrastrukture, željezničko osoblje i posebno osoblje na vozovima koji saobraćaju na području Evropske zajednice, željeznički vozni park, radionice za održavanje željezničkih voznih sredstava, materijali i oprema na željeznici. Obaveze koje proizilaze iz Evropskih pravila za željeznički sistem, iziskuju redizajn javnih željezničkih kompanije u BiH, Regulatorni odbor za željeznice BiH i Bosansko-Hercegovačka željeznička javna koorporacija. Ulazak BiH u Evropsku zajednicu, dovodi do primjena direktiva i uredbi za željeznicu u nacionalno zakonodavstvo, što je zadatak za željeznički sektor u BiH i za nosioce vlasti. Ogromna prepreka je način pripreme željezničkih preduzeća za pristup evropskom tržištu, a naručito su važne sadašnje i buduće obaveze željezničke infrastrukture, jer i kod sadašnjeg načina domaći javni željeznički prijevoznici mogu samostalno ekonomski poslovati. Održivo poslovanje željezničke infrastrukture bez finansiranja troškova njenog održavanja nije moguće, a istovremeno pitanje je da li će eventualno otvaranje tržišta proizvesti veće prihode za željezničku infrastrukturu. Generalno, čini se da je postojeći zakonski okvir fleksibilan za brzu prilagodbu evropskim pravilima, ali glavna prepreka je u tehničkom i ekonomskom dijelu.
